Background

  • Competency is a legal term that concerns the mental capacity of an individual to participate in legal proceedings or transactions, and the mental condition a person must have to be responsible for his or her decisions or acts
    • A court or judge determines competence
    • Typically including guardianship and conservatorship hearings
  • Incompetence - lack of ability to understand either health care or financial management decisions
