Background
- Competency is a legal term that concerns the mental capacity of an individual to participate in legal proceedings or transactions, and the mental condition a person must have to be responsible for his or her decisions or acts
- A court or judge determines competence
- Typically including guardianship and conservatorship hearings
- Incompetence - lack of ability to understand either health care or financial management decisions
